Welcome to TraceVita. These Terms & Conditions govern your use of the Tracevita mobile application and any related services, content, features or functionality (collectively, the “Services”) offered by Tracevita Ltd.
Please read these Terms carefully. By accessing or using the Tracevita Services you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Services.
1. The Services
Tracevita provides brief description of what the app does, e.g., tracing health data, lifestyle suggestions, analytics, reminders, etc.. The Services may include Content created by Tracevita, automated recommendations, or information provided by third parties.
2. User Responsibility & Use of the Services
- You are responsible for the information you provide to the Service and for determining whether the Services are suitable for your purposes.
- You agree to use the Services only for lawful purposes and in accordance with these Terms.
- You must not misuse the Services, submit false information, or attempt to gain unauthorized access to our systems.
3. No Guarantees / No Warranties (Important please read carefully)
Tracevita provides its Services “as is” and “as available”. Tracevita expressly disclaims all guarantees, warranties and representations of any kind (whether express, implied or statutory), including any warranties of merchantability, fitness for a particular purpose, accuracy, reliability or completeness.
Specifically, and without limiting the foregoing:
- Tracevita does not guarantee, warrant, or promise any specific results or outcomes from using the Services.
- Recommendations, data, and Content provided by the Service are for informational purposes only and may be based on limited, third-party or automated sources.
- It is the user’s sole responsibility to evaluate the accuracy, usefulness and suitability of any Content, recommendations, or actions suggested by the Services.
BY USING THE SERVICES, YOU ACKNOWLEDGE AND ACCEPT THE FOREGOING.
4. Health, Legal & Professional Advice
If the Services provide health-related, financial, legal or other professional information, such information is not a substitute for professional advice. Always seek the advice of a qualified professional with any questions regarding diagnosis, medical treatment, financial or legal matters. Never disregard professional advice or delay seeking it because of something you have read or seen on Tracevita.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Tracevita, its affiliates, officers, directors, employees, agents and licensors will not be liable for any direct, indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenues, data, or use, arising out of or in connection with your use of (or inability to use) the Services, even if Tracevita has been advised of the possibility of such damages.
Where applicable law does not permit the exclusion or limitation of liability described above, Tracevita’s liability shall be limited to the maximum extent permitted by law.
6. User Content & License
If you submit any content (including feedback) to Tracevita, you grant Tracevita a worldwide, perpetual, irrevocable, royalty-free, transferable license to use, reproduce, modify, adapt, publish, translate, and distribute such content in connection with the Services. Do not submit content you do not own or have rights to.
7. Privacy
Your privacy is important. Our Privacy Policy explains how we collect, use and share information about you. By using the Services, you also agree to our Privacy Policy which is incorporated into these Terms.
8. Accounts & Security
- To access certain features, you may need to create an account and provide accurate information.
- You are responsible for safeguarding your account credentials and for all activity that occurs through your account.
- Notify us immediately of any unauthorized use or security breach.
9. Payments, Fees & Refunds
If the Services include paid features, you will be presented with pricing and payment details. All fees are non-refundable except as specifically provided in writing. Tracevita may change subscription fees or add new fees; we will provide notice as required by law.
10. Third-Party Services & Links
The Services may contain links to third-party websites, services or resources. Tracevita does not control those third parties and is not responsible for their content or practices. Links do not imply endorsement.
11. Termination
Tracevita may suspend or terminate your access to the Services at any time for breach of these Terms, at our sole discretion, or as required by law. You may stop using the Services at any time.
12. Indemnity
You agree to indemnify and hold Tracevita and its affiliates harmless from any claim, demand, loss, liability, cost or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of a third party.
13. Changes to the Terms
We may modify these Terms from time to time. If the changes are material, we will notify you by email or in the app before they become effective. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the United Kingdom. Any dispute arising out of or relating to these Terms shall be resolved by the courts of British jurisdiction, except where mandatory law requires otherwise. Where allowed, parties will attempt to resolve disputes through good faith negotiation or mediation before litigation.
15. Severability & Entire Agreement
If any provision of these Terms is found to be unenforceable, that provision will be severed and the remainder of the Terms will remain in full force and effect. These Terms constitute the entire agreement between you and Tracevita regarding the Services.
16. Acceptance & User Acknowledgement (Mandatory)
Please read this section carefully. By using the Tracevita Services you explicitly acknowledge and accept the following:
- You have read, understood and agree to be bound by these Terms & Conditions (including the Disclaimer and No Guarantees clause in Section 3).
- You accept that Tracevita provides the Services “as is” and makes no guarantees, warranties, or promises regarding any specific outcome, result, or benefit from using the Services. Any Content, recommendations, or information provided by Tracevita are for informational purposes only. It is your responsibility to evaluate such information and to seek professional advice where appropriate.
- You accept full responsibility for decisions or actions you take based on Content provided by Tracevita and acknowledge that Tracevita is not liable for outcomes arising from your use of the Services, except as may be required by applicable law.
